THE biggest threat to the banks traditional stanglehold over their customers comes from the internet. Some analysts believe that the new web-based entrants into the financial services market could within a decade have eclipsed the high street banks altogether. So-called Monoliners, on the other hand, are able to focus on providing just one type of financial product - say personal loans, high interest deposit accounts or mortgages - direct to their consumers, and usually via the internet. The best known examples are Prudentials Egg, Standard Life Bank and Charles Schwab, the web- based stockbroker. The banks are to some extent handicapped in this market, whose potential they were slow to acknowledge. Their old-fashioned infrastructures, based on a mixture of branch banking and electronic media, mean they are obliged to make a virtue out of having what they term a multi-channel distribution strategy. Given the choice, and were it not for political considerations, many banks would probably close many of their branches tomorrow.

As the mirage of zero-cost transactions and endless customers from afar vanishes with the dotcom bust, distributors have begun to wonder if the pressure to evolve an Internet-based solution has also begun to recede. Over the past decade, traditional selling has become more difficult as the typical customer transformed in response to the dramatic reduction in the workforce. As the numbers of people performing business functions declined, a typical purchasing agents activities exploded. Gone were the clays of simply making phone calls, mailing RFQs, and studying pages of comparative prices. With more tasks to perform buyers become harder to reach and have far less time to listen to a sales presentation — even for key product lines. Theyve become smarter, more mindful of cost-effectiveness, and far more ready to demand special services such as customized specs in all product categories, JIT delivery, planned inventory, special training, and round-the-clock technical support while seeking to reduce the total number of suppliers.
Not a day goes by without yet another article extolling the virtues of the Internet. An estimated 30 million worldwide users to date and more logging on every day. To the small business owner, the real question is, Where does the hype end and the reality begin? Is the Internet really a viable proposition for the traditional small business, normally constrained by lack of time, staff and money? 10 questions to ask yourself The best way to determine whether or not the Internet makes sense for your business is to apply a simple “yes” or “no” answer to 10 important marketing questions: 1. Do my clients require specific product information before they can buy my product/service? 2. Do I spend a majority of my time selling the benefits of my product only to be asked, “Can you send me more information?” 3. Is my long-distance phone bill more than $100 per month? 4. Have I lost business as a result of playing phone tag with a potential customer because I was unable to “sieze the moment?” 5. Customers and prospects can view that information at their own pace — in many instances, via sophisticated video and audio commercials. Since were talking digital information here, there is very little difference between one word and one thousand words. And if you feel that youre spending too much time processing paperwork and not enough time selling, a well-designed Web page may be one of the potential keys to your businesses future success. How important is e-mail? An important byproduct of the Internet is e-mail, or electronic mail. Once you learn to use this valuable tool, youll wonder how you ever got along without it. After you feel that youve developed a solid grasp of the different portions of the business that youd like to present to your clientele, you are now ready to interview potential agencies who are skilled in creating Web pages. According to Vick, there are 3 questions you should ask a potential Web page creator: 1. Have you done this before? 2. Who have you done this for? 3. May I call them? While creating some Web pages may require the skills of a computer Ph.D., most will not, and there are competent companies in most major markets capable of accomplishing the task in a cost-effective fashion. Prices for creating a simple Web site can range from a low of $2,500 to high of $20,000. In fact, some of the Fortune 500 marketers have created sophisticated and complex Web pages that can literally run into the hundreds of thousands of dollars, and in some cases, the millions. But for the average small business, the investment will probably be in the $5,000 to $10,000 range. And remember, you must keep your Web site content fresh, or your prospects will have no reason to come back. Seeing your own World Wide Web site up and running on the Internet can be a proud moment for any business owner. It also can mean the start of a whole new way of doing business. It has the potential to increase productivity by extending operating time to a full 24 hours a day. But this will only happen if your business really needs this technology and can use it effectively. Despite recent stagnation in real property values, commercial lenders continue to look to real estate as additional collateral to support loan transactions. Issues include: (1) reviewing title and insuring the lenders real estate lien by purchasing a title insurance policy; (2) whether to require an ALTA survey; (3) environmental review; and (4) structuring issues affecting the lenders ability to maximize recovery in the event of foreclosure. For most commercial lenders, real estate is typically considered a secondary source of collateral. Most commercial lenders will only consider taking a lien on real estate when significant underwriting circumstances require it. Such a circumstance often arises when the lender determines that a borrower is deficient in personal property assets to support the proposed loan. Real estate can be a critical collateral source that allows the lender to get the deal credit approved. Often, in these circumstances, the lender considers the real estate “boot” collateral. Thus the lender may take a cavalier approach in the due-diligence process with this collateral because of the lenders desire to minimize the borrowers transaction costs.
Editors Synopsis: This article examines the benefits that Subordination, Nondisturbance, and Attornment (SNDA) Agreements provide to lenders, landlords, and tenants. The authors discuss provisions that protect lenders and tenants, and review developments in the law related to SNDA agreements. However, even the most favorable leases, standing on their own, do not provide the security that lenders seek. The leases are mutual promises between landlords and tenants that do not form a direct contractual relationship between the producers of the income that have formed such an important part of the lenders underwriting (the tenants), and the parties secured by the income (the lenders). Absent any contractual agreement between lenders and tenants, both parties are subject to the operation of the applicable law in determining whether they can retain the benefits they anticipated when deciding to proceed with their respective contractual commitments. A foreclosure may expose the lender to the risk of losing relied-upon lease income, and the tenant could lose its leasehold interest in the mortgaged property-a result that, under normal circumstances, would work to the detriment of at least one of the parties.2
Commercial lending is frequently thought of as one of the few remaining unregulated business activities, free from the plethora of laws and regulations that place numerous restrictions on other financial services businesses. Many commercial lenders would be surprised, however, at the number and variety of rules applicable to commercial lending activities. Following is a brief review of key laws and regulations which have potentially significant implications for commercial lenders. (References to “banks” below generally includes thrift institutions unless otherwise noted.) ECOA prohibits discrimination in the extension of credit on the basis of race, color, religion, national origin, gender, marital status, age (provided the applicant has the capacity to enter into a contract), because all or part of an applicants income is derived from a public assistance program, or because the applicant has exercised a right under the Consumer Credit Protection Act. The Act applies to all types of consumer and business credit transactions, although it has a limited impact on public utilities credit, securities credit, incidental credit and government credit. To ensure compliance with ECOA, commercial lenders must have an effective nondiscrimination policy, adopt procedures and forms for providing notice of “adverse action” (e.g., a denial of or counteroffer to a loan application or an unfavorable change to an existing credit), ensure that marketing efforts cover all geographic segments of the market and, if they make multifamily housing loans (including for construction, development, or rehabilitation), post Equal Housing Lender notices in publicly accessible offices (including offices adjoining a bank branch office). In addition, commercial lenders should ensure that sales, marketing and underwriting staff understand the concept of “disparate impact,” under which the critical issue is not whether discrimination was intended but whether the effect of a lenders act or practice was discriminatory.

They argue that, if marijuana, cocaine, heroin, and other drugs were legalized, several positive things would probably occur: (1) drug prices would fall; (2) users would obtain their drugs at low, government-regulated prices, and they would no longer be forced to resort to crime in order to support their habits, (3) levels of drug-related crime, and particularly violent crime, would significantly decline, resulting in less crowded courts, jails, and prisons (this would allow law-enforcement personnel to focus their energies on the “real criminals” in society); and the drug production, distribution, and sale would no longer be controlled by organized crime, and thus such criminal syndicates as the Colombian cocaine “cartels,” the Jamaican “posses,” and the various “mafias” around the country and the world would be decapitalized, and the violence associated with drug distribution rivalries would be eliminated. By contrast, the anti-legalization camp argues that violent crime would not necessarily decline in a legalized drug market. In fact, there are three reasons why it might actually increase. First, removing the criminal sanctions against the possession and distribution of illegal drugs would make them more available and attractive and, hence, would create large numbers of new users. Second, an increase in use would lead to a greater number of dysfunctional addicts who could not support themselves, their habits, or their lifestyles through legitimate means. Hence crime would be their only alternative. Third, more users would mean more of the violence associated with the ingestion of drugs. These divergent points of view tend to persist because the relationships between drugs and crime are quite complex and because the possible outcomes of a legalized drug market are based primarily on speculation. However, it is possible, from a careful review of the existing empirical literature on drugs and violence, to make some educated inferences.

LAWYERS who had wanted General Pinochet extradited were still trying early last week to decide what “legal steps” they could take to stop him going to Chile. For some reason I found myself thinking of the sad advertisements one used to see occasionally in the personal columns: “Public school man seeks interesting job, anything legal considered.” But of course I was confusing two different functions of the word legal. Ethical began by meaning “to do with ethics”, and only later came to mean being good. The purist in me still winces when someone says “aesthetic” when they mean “in good taste”. (Aesthetic originally meant “to do with the science of perception”, then “to do with taste”, good, bad or indifferent.) But there was never any need for legal to carry two meanings, because theres a perfectly good alternative that takes half the burden off it: lawful, a nice old word from the late Middle Ages (its parent word, law, appears to be of ancient Scandinavian origin). Everyone understands the difference between “legal business” and the “lawful business” that most of us spend our lives going about. Why couldnt those job-seekers have put “anything lawful considered”? Lawyers use lawful, too; they speak of a “lawful killing”. They dont say “a legal killing” (which, if it meant anything, would presumably refer to their fees).

The search for a missing southern Utah man is getting a boost from a team of private investigators. The Private Investigator Association of Utah is volunteering some of its members time and skills to help track down Christopher Coan. Its a case that has perplexed police and left his family heartbroken. Coan, 18, vanished from a Subway shop in Iron County on Sept. 3, 2007. He left his drivers license, clothing and money behind. His 1994 maroon and silver Chevy S-10 Blazer with stickers on the back window hasnt been found. The temporary license tag expired in October, and the vehicle has been listed as missing in a national crime database.
Most of us have strange preconceptions of the role of the private investigator, but these were dispelled by an informative and humorous presentation by David Staves of Legal Services UK Investigations. David is a member of the Association of British Investigators and a member of the Certificated Bailiffs Association and has ensured a reputation for operating within a strict code of practice offering a reputation for total professionalism. AN ADVERT for designer fashion brand Armani was criticised yesterday for “sexualising children”. Orthet, which holds the UK licence for Armani Junior , did not comment to the ASA on the complaints but agreed to withdraw the advert and not to use it again. The Times told the watchdog it had received 10 complaints after the advert appeared in its magazine. The ASA said the picture made the models gender ambiguous and drew attention to the childs sexuality.

To guide the development of DHPW products, services, and policy for the ADCS, DHPW conducted a survey of dental health promotion and preventive dentistry practices within the ADCS. The survey queried the frequency with which dentists deliver such services and the type and source of their patient educational materials. In this paper, we report the findings of that survey and discuss their implications for improving the delivery of dental health promotion and preventive dentistry services in the ADCS.

The latest bizarre episode in the life of George Galloway took place yesterday, when a rubber “stress ball” flung from an office window scored a direct hit on the Respect MP as he campaigned in central London. Mr Galloway, 53, who is standing for a seat in the London Assembly, was on the upper deck of his open-topped “battle bus” when the missile caught him on the temple, leaving him bruised. The ball was believed to have been thrown from a building in Theobalds Road, Holborn. A man was arrested and was being held in custody last night.

Sten Corp., based in Minneapolis, said Monday its Sten Financial Corp. has completed the acquisition of substantially all of the assets of Cash Advance LLC, based in Salt Lake City. Utilities that operate in northern climates typically have winter-disconnect moratoriums, while those in the South do not. Not being able to disconnect a customer for nonpayment over a four-to-five-month period can wreak havov on performance indicators. In such an example, only utilities with winter-disconnect moratoriums ought to be compared with each other. (See Sidebar, “Defining Metrics.”) Likewise, billing can present various uniformity challenges. Companies that use multivarious billing systems must be separated according to what systems are most similar in order to produce an apples-to-apples comparison. The result of such an analysis may well be that a meaningful comparison is simply not possible because of multiple and complex differences in operational management. But for most utilities, their customer service operations share enough similarities upon which to perform useful-and potentially lucrative-benchmarking.
A further drawback to relying on accounting measures of performance is that one of the central principles of accounting, the matching principle, is not always followed, especially when it comes to RD, product launch, and other costs where the anticipated revenues wont materialize until future accounting periods. These factors, along with others such as channel stuffing, open wide the door to gaming merit-pay systems where bonuses are based on conventional accounting measures of performance, rather than EVA (economic value added) measures. The CFOs budget, planning, audit, and control functions need to expand to include performance evaluation based on an assessment of the degree to which managers follow shareholder-value maximizing principles in their decision making. There are many EVA measures that can serve as guidelines. Unfortunately, none were laid out in the article.

Then there is the problem of what you do with the decorations when youve taken them down. Pop them in a dusty cardboard box on the wardrobe? Not if you want to avoid “dreadfully bad luck”. Until relatively recently, it was de rigueur in rural parts of southern England to burn the lot, preferably using them (were talking holly, ivy, etc, not plastic Santas) to cook the Shrove Tuesday pancakes. On the other hand, northerners thought it “sinful” to torch the tree. In Worcestershire, they swung both ways: “If Christmas holly burns with a crackling noise, it is a sign of good luck. If it does not crackle, it is a sign of death in the family within the year.” All clear now? I gleaned these invaluable tips from The Penguin Guide to the Superstitions of Britain and Ireland by Steve Roud (Penguin, pounds 25). This encyclopaedic haul indicates both the inventiveness and ubiquity of superstitions. To cite just a few examples, it is considered unlucky to keep your handkerchief folded in your pocket, poke anothers fire, drop scissors, allow a cut onion in the house, point at a rainbow, give someone parsley, borrow salt, wear black at New Year (too late for you fashionistas), enter and leave by different doors, pick up a dropped comb, have anything to do with peacock feathers, find a left-hand glove, laugh too heartily, look in a mirror before the age of one, have a mole on the neck (”trouble by the peck”), wear an opal engagement ring, sneeze to the left, wash your hands in the same water as someone else or see an ambulance (though the ill-luck from this spectacle can be mitigated by seeing a four-legged animal). The insistence on never looking at a new moon through glass seems particularly unfair to we spec-wearers. Mr Roud, who works in that mystic nexus known as the Croydon Public Library, reveals that many superstitions have a long lineage. Pliny enquired in AD77: “Why on the first day of the year do we wish one another a happy and prosperous new year?” But many others are surprisingly recent. The best-known superstition of all, about not walking under ladders, dates from the 1880s, when, presumably, many people were having their houses painted. (Punch pointed out in 1881 that it was even worse luck to step into the road and be run over by a traction engine.) The belief that it is bad luck to have 13 sit down for dinner was first mentioned in print in 1695, some 1,660 years after 13 sat down at the Last Supper.

Early on, when the Kappa Alpha Theta Alumnae Association inaugurated its Flaming Festival, the benefit featured nothing but tables decorated with candles and each table with a theme such as Christmas, childs birthday or football watching. These tables were decorated by Theta members. Ruth Meyers will present a fashion show during the luncheons, which will have seatings at 11 a.m. and 1 p.m. Reservations for these are $15 each and must be made in advance by calling Ann Fleming at 359-6116. She is luncheon co-chair with Gennie Johnson. Festival tickets are $3 in advance or $6 at the door. The Theta Philanthropy Committee once again has decided to grant Festival proceeds to the University of Oklahoma Institute for Breast Health for two Breast Oncology Summer Fellowships, a commitment that will extend for five years. Breast cancer is the leading cause of all deaths in women between the ages of 35 and 50 and one in nine women eventually will be afflicted with the disease, according to information from Harriet Weirich, co-chairman of the Festival. Her co-chair is Susan Sigmon. In the Underwriter category, with a donation of $200 or more, the donor receives two tickets to the seated luncheon and 10 Festival tickets. Sponsor category at $100 or more receives 10 tickets to the Festival and some perks. Patron category of $50-$99 includes recognition in the Festival program and a special name tag. Bouquet of Art Wednesdays column included information about another sorority benefit — the Bouquet of Art exhibit and sale sponsored by Delta Delta Delta Alumnae Association. Unfortunately, the date of the show was in error. The benefit will take place Saturday, Nov. 22, at Oklahoma City Golf and Country Club. Thirty-one artists will have their works on view and for sale with proceeds benefiting the Department of Pediatrics at the University of Oklahoma College of Medicine. Miniature masterpieces Miniature masterpieces of painting, sculpture and pottery will be on display at the 50 Penn Place Gallery Saturday with a free reception from 6 until 8 p.m. The gallery is on the third retail level. Bill Thurman bows out Making his farewell appearance before Executive Women International, William G. Thurman (thats Bill in the bow tie, of course) talked on “Medicine in the Media — Fact vs. Fiction.” While the subject was serious, it was presented with his wry sense of humor. Pointing out that few people listen to their doctors, he said most folks are influenced by medical news they hear on television and radio or read in newspapers, magazines and tabloids. “Newspapers are the worst about medicine,” he said, apologizing to newspaper representatives in the audience, “and, fortunately, the tabloids dont pick on medical information. Magazines and TV are bothering us (in medicine), especially those like Better Homes and Gardens and McCalls. For some reason, patients are convinced that what they read is true. “When there are problems (in medicine), the wire services often are purposefully provocative,” he continued, citing conflicting stories, the speed of communications, translation and choice of “experts” as examples of problems. “This confuses the patient,” he said. Bill listed as examples of “scare medical stories” the 1959 cranberries, “killer” hot dogs, saccharin, hair dyes, Tris (infant sleepwear), Love Canal, high voltage wires, toxic teeth and asbestos. “Oh, the cellular phones,” he said with a wry smile as a cellphone rang in someones pocket. Harvest Food Festival Bring a can of food — or several — and join the festivities of the Oklahoma City Food Banks Harvest Food Drive Cans Festival on Saturday. From 8 a.m. until noon at Penn Square, guests will watch 20 businesses and schools join to assemble giant sculptures created with canned food. Children may have their faces painted downstairs by the Cans Sculpture activities. The can sculptures will remain on display until Nov. 9. Last year, the Cans Festival raised a record 64,000 pounds of food. Area Boy and Girl Scouts are distributing plastic bags with flyers to homes and apartments in the area on Nov. 8, and will pick them up — hopefully filled with non-perishable canned goods — at 8 a.m. Nov. 15.
